This 5 amount represents compensation for all legal services rendered on behalf of 6 Plaintiff by counsel in connection with this civil action, in accordance with 28 7 U.S.C. §§ 1920; 2412(d). 8 After the Court issues an order for EAJA fees to Bachstein, the government 9 will consider the matter of Bachstein's assignment of EAJA fees to Marc 10 Kalagian. The retainer agreement containing the assignment is attached as exhibit 11 1. Pursuant to Astrue v. Ratliff, 130 S.Ct. 2521, 2529 (2010), the ability to honor 12 the assignment will depend on whether the fees are subject to any offset allowed 13 under the United States Department of the Treasury's Offset Program. After the 14 order for EAJA fees is entered, the government will determine whether they are 15 subject to any offset. 16 Fees shall be made payable to Bachstein, but if the Department of the 17 Treasury determines that Bachstein does not owe a federal debt, then the 18 government shall cause the payment of fees, expenses and costs to be made 19 directly to Law Offices of Lawrence D. Rohlfing, Inc., CPC, pursuant to the 20 assignment executed by Bachstein.1 Any payments made shall be delivered to Law 21 Offices of Lawrence D. Rohlfing, Inc., CPC. Counsel agrees that any payment of 22 costs may be made either by electronic fund transfer (ETF) or by check. 23 24 25 1 The parties do not stipulate whether counsel for the plaintiff has a cognizable lien under federal law against the recovery of EAJA fees that survives the Treasury 26 1 This stipulation constitutes a compromise settlement of Bachstein's request 2 for EAJA attorney fees, and does not constitute an admission of liability on the part 3 of Defendant under the EAJA or otherwise.
